I am a tenant renting an 3-bedder HDB unit, with a total of 4 occupiers, myself, my parents and a cousin. With the rising rent prices in the market, my girlfriend’s tenancy agreement has ended and she did not manage to find a place to move so we asked my parents and her parents to allow us to let my girlfriend move in to this house and have this arrangement despite not being married yet. Both sides have given us the blessing.

I informed landlord yesterday that she will be moving in this weekend and to add her name to the occupier’s list in the tenancy agreement, and listing in HDB side to which he didn’t agree as he said it’s against his morality and beliefs as a Christian.

I understand this as both my girlfriend’s family and my side of the family are Christians, but we have received both parents’ blessing and we will be staying with my parents and cousin, making it a total of 5 occupiers.

I have also revisited the TA and it only states there to provide necessary documents to prove legal stay in Singapore for new occupiers to be added in the tenancy. I believe his morals and religion should not be a criteria or measuring stick to consider future occupiers, as the TA did not state this.

Kindly advise us on how to proceed with this. Thank you so much to anyone who will support to explain and answer this enquiry!

Dear sir,

Religious beliefs aside, your landlord is not wrong to disagree on adding your girlfriend as an occupier to the flat, since from contractual perspective when you enter into lease agreement with the landlord, only your family is stated as the occupiers, unless there is a clause that allows you to add on additional occupant into the apartment, otherwise whoever that is mentioned in the tenancy agreement as authorised occupants will be the ones authorised to stay.

I am unsure of what the contents of your Tenancy Agreement has, and in such circumstances, you should visit a lawyer for professional advise to see if your girlfriend can be legally added as an occupant in this case.

    with limited understanding of the entire agreement, basing on the clause you have copied out, it stated "and thereafter, before any new permitted occupant moves in." indicated that landlord must agree to the new occupant. Tenant does not have the right to add in new occupant. Even in the event that 1 of the permitted occupant has given birth, this can also complicate the occupant list which I have the bad experience of handling this before. Unreasonable? Perhaps, but this is the legality of agreement. If you wish to challenge the agreement, then you should seek professional advise from the lawyer.

    Here’s the sub clause in the TA:

    The tenant shall produce to the Landlord for inspection the originals of all occupants’ identity cards/passports and other relevant documents evidencing their legal entry into and stay in Singapore before the commencement of this Agreement, and thereafter, before any new permitted occupant moves in.

    I also checked whole TA and there’s no other stipulation or sub-clause stating that only family members are allowed. Does this mean that I have a right as a tenant to allow my girlfriend to move in?
