Asked by
I am a single citizen currently living in an HDB flat owned by my younger sibling (my only sibling, who is also single) and my mother, who is a widow. In other words, I am just an occupant of the HDB flat and do not own it at all.

Both my younger sibling and I are under 35 years old at present. If my mother were to pass away before either my sibling or I turn 35 (i.e., still under 35), and my sibling is the only surviving owner of the flat but is still below 35, what would happen to the property?

Additionally, would this situation affect my residency in the flat?

If your mother were to pass away, you and your sibling, as long as you are both Singaporean citizens and over 21 years old, might be able to inherit the unit Read More

1. If your mother passes away, you and your sibling can inherit the HDB unit, provided you are both Singapore citizens and over 21 years old.

2. As orphaned siblings, you are eligible to keep the property, but you may need to be listed as co-owners or essential occupiers.

3. Ensure both of you are recognized as eligible owners to retain the unit after your mother's demise.

Hi,

1) Since you mentioned only surviving owner of the flat, I assume this flat is hold under Joint-tenancy.
2) Your brother will become the sole owner of the flat.
3) Even though your brother has not reach 35, he is able to hold on to the flat under orphan scheme.
4) This will affect you since you are not allowed to buy an HDB flat under the orphan scheme.
5) You may only buy a flat when you reach 35 yrs old under Single Citizen Scheme.
6) The changes does not affect your residency in the flat as long as your brother don't chase you out.

All The Best!!!

Hope the above answers your main concerns, but if there are more queries, please feel free to contact me at 9011*0636 or email: ling.ck7@gmail.com if more information is needed.
I'll be glad to assist.
