I am a Singaporean and have a property overseas with my spouse (foreigner). If I withdraw my ownership and transfer this overseas property to my spouse, can I apply a new EC with my daughter who is also a Singaporean? Or do I have to wait 30 months to be eligible?

Dear sir/mdm,

30 months period after disposal of interest in private residential properties is applicable including overseas properties if you are planning to apply for a brand new EC.

I am unsure which project you are targeting, however, given the lock in period of close to 8 years due to the construction and minimum occupation period required to be met for all brand new ECs purchases, will it make sense from investment opportunity or to look into the resale options where not only you are able to sell at any point of time after purchase subject to relevant stamp duties regulations, you also need not dispose your existing interests in the overseas property.

Or is there other reasons which I may know in your interest in a brand new EC that is helpful to know?

Hi,

For new EC, the 30 months wait out period applies after you have removed the overseas property ownership. Further, as your spouse is foreigner, you will not be eligible as new EC requires SC-SPR family nucleus. For resale EC after 5 years MOP, no such issues.

Good afternoon Sir,

You have to dispose off your overseas property first and observe 30 months waiting period before you are eligible to apply for a new EC.

Having said that, your wife has to be included in the application but she is a foreigner thus you wont be eligible to apply for new EC.

Will you consider the private segment where you dont have to sell off your overseas property and buy with your wife without being subject to ABSD (matrimonial home)?

Hi,

Both you and your spouse must not own any private properties 30 months prior to your application for a brand new EC. This means that you cannot transfer the property to your spouse.

Should you wait out 30 months after selling away your overseas private property, you can apply for a new EC under Public Scheme, with both your foreigner Wife and your Singapore Daughter as essential occupiers.

If you do not wish to wait for 30 months, and find the eligibility conditions of owning and EC too strict, you may wish to consider private housing instead. There are private condos in better location and with greater potential than ECs.
