I am a Singapore Citizen, and my spouse is a Singapore PR, and we do not own any property currently. We are about to exercise our S&P in a couple of weeks, but I just learnt that we may be subject to ABSD.

We are planning to register our marriage a couple months after we exercise the S&P. May I know if we are still required to pay the ABSD on exercising the S&P? If so, is it fully refundable after we submit our marriage cert afterwards, and are there any conditions we should be aware of?

Or is there any way to waive the ABSD requirement, in view that we will be able to produce a marriage cert afterwards?

Hi,

Not sure where did you got the information from. It is better to seek professional advice with regards to such important matter, especially this involves tens of thousand.

Since you never mentioned whether you are buying HDB or private, I hereby assume you are referring to HDB.

(1) Buying BTO/new flat from HDB:
You have to produce marriage certificate if you are buying a flat under the Fiancé/Fiancée Scheme and applied for the Additional CPF Housing Grant (AHG) upon key collection.

(2) Buying resale HDB:
You have to produce Marriage Certificate, if apply via Public scheme in your first appointment, which is also the time signing your S&P.
However, in your case, you should have applied using Fiancé/Fiancée Scheme. Thus only need to submit Marriage certificate within 3 months from resale completion date.

Since this is your matrimonial home, you are not required to pay ABSD, but ensure your marriage certificate is submit within the specified time frame as stated above.

Although this advice might not come on time, because not sure how close it is to your 1st appointment. Hopefully you can still do something about it.
