I am a Singapore Citizen (33 years old) and my wife is a SPR. We have a 4 room HDB (BTO) just collected the key from HDB in one year ago. i am the sole owner and she is occupier, i paid all of the down payment and the installment.

I would like to ask if we are going to divorce, and she agree to give up the HDB, can i retain the HDB unit with myself?

I checked HDB website the information is i must be 35 years old and need to meet 5 years MOP.

However i checked with Lawyer, he told me if my wife agree, we can apply the court to allow my wife pass the HDB unit to me after MOP (means 4 years late),will be written in the court order.

In the meantime we can proceed to divorce immediately.

Is that true? can i retain the HDB with myself we we did like what the laywer said?

Morning Jere,

As your unit have not fulfilled MOP, HDB is unlikely to grant you part purchase for the unit. Even if they do, you are not of the eligible age yet.
As for divorce cases, HDB would recommend sales of the unit within 6 months from absolute. In your case, HDB would most likely buy back the unit from you, at market price.
Alternatively, you can file for separation while wait for the MOP to kick in. That's from my knowledge as salesperson.
