I am a PR with a SG citizen daughter. If I buy a HDB flat after divorce and my child becomes a co-owner, what happens to the cash proceeds when I sell the flat? Will my daughter be entitled to 50 percent because she is a joint owner? Even if she has paid no money towards the flat?

Hi,

1) In order for your daughter to be a legal co-owner. She must have reached the legal age of 21 yrs old.
2) There are 2 types of ownership available for 2 or more owners in a property; Joint-Tenancy or Tenancy-In-Common.
3) The former is the most popular ownership, that is all owners will have an equal share of the property.
4) The latter type can decide how many shares each owner owned; it can be 50/50, 60/40, 70/30, 80/20, 90/10, and other types of combination. All owners have to decide how much each owner is entitled to the property.
5) If you are using Joint-Tenancy, then it is apparent that your daughter will get a 50% share once the flat is sold, even she has never paid a single cent to the property.

Hi,

Your daughter needs to be above age 21 in order to be a co-owner with you. If she's below 21, then she will be listed as an essential occupier.

In terms of sale proceeds, it will depend on the manner-of-holding in which you purchase the HDB flat. Joint Tenancy is most commonly used, but if you wish to "protect" your stake, you might wish to choose Tenancy-in-Common under 99/1 as your manner of holding.
