I am a buyer who has recently exercised an option to purchase a resale condo. I proposed to bring forward the completion date by a month (ie complete earlier by one month).

The seller’s lawyer (referred by the property agent acting for the seller) wants us (the buyer) to pay a fee of $218 for bringing forward the completion date. We have checked with our lawyers who has advised us that this is not an industry practice and is tantamount to a bullying tactic.

Has anyone faced a similar situation before? Are we able to lodge a complaint against this seller’s lawyer with the relevant authorities? I would appreciate any advice.

You have requested to bring forward the completion day, the sellers also have a right not to agree and on the advise of their law firm, if they are agreeable to bring forward but at $218, because they need to expedite the works to be done for the advance completion, if you are not agreeable then you can allow the completion date to remain as it is.

Lawyers work on the interest of their clients, therefore your lawyer is also working to your interest while seller's lawyer is working to their interest. There is nothing wrong with this amount being requested for in order to expedite the process since it is differing from original agreement. Is your lawyer charging you additional for requesting to advance the completion date? Hi,

1) In general completion, it will take about 3 months from the exercise date to complete all the paperwork.
2) This completion period could be shortened to 2 months when the property is free from outstanding mortgage loans.
3) This is because this legal process involves approval from 8 authorities, and these authorities also need time to check/update their record before approving.
4) The requested fees from the seller's lawyer could be overtime pay and extra efforts needed for their staff to chase after the authorities and financial institute.
5) Your lawyer is not wrong to say that it is unusual to ask for a fee to expedite the process because usually, the law firm will just reject the request.
