I (32 years old) and my wife is getting a divorce, we are both Singaporeans.
I'm looking to transfer our flat to my brother who is 35 years old and married to his wife LTVP holder.
Would it be possible and what are the steps + fees for this process? Can I engage with an agent on this to settle everything? Thanks

Also, will my wife be eligible to view/ book a resale flat during or only after the final documents from the court is confirmed?

Is the transfer or sale to your brother and his wife agreeable between you and your wife? If both are agreeable, and your brother and his wife on LTVP are eligible to purchase a HDB with the necessary financial means, it can be sold to your brother and you need not any agent to work on this process.

Is there any children? Is your wife 35 or above? Whether or not she is eligible to purchase another HDB will be dependant on several factors and if she is fulfils the criteria to purchase a HDB, then she will be able to do so after the final settlement for the divorce.

    Hi Geryl,

    1/ For the sale process:
    - Would I engage with an agent on this? If yes, how much in total for the whole process to be completed since we just want to keep the flat and avoid all the costs as much as possible?-
    - Can I sell it to my brother at the same price as when I purchased the BTO so we can get the loan to cover this takeover of ownership? Or must it be the price for a resale flat in the open market?
    - When I turn 35 years old, it would be 3 years later and he won't be meeting the MOP if I transfer the name to him under a sale. So do we have to wait only he reaches the MOP so I can purchase back the flat or it can be done earlier once I'm 35 and he can book his own BTO?

    if all parties are agreeable, then you can initiate a sale process (if you have met the 5 years minimum occupation period), where he will purchase over the property from you and your wife. If he does not apply to take any housing grant, he will still be eligible to apply for BTO as a first timer after meeting the 5 years minimum occupation period. If you decide to purchase back this HDB after you have turned 35, it will be a similar process that your brother will sell back the property to you.

    Your wife will need to submit for HLE to determine the amount of loan she is eligible for the purchase and you can find out more about the income guidelines at https://www.hdb.gov.sg/residential/buying-a-flat/financing-a-flat-purchase/application-for-an-hdb-loan-eligibility-hle-letter/income-guidelines-and-documents.

    Both are agreeable to the transfer, do you know how much would it cost for the transfer can be done? And will it be considered the first timer for my brother that he won't be able to get his BTO flat after I turn 35 and transfer back the ownership under my name?

    Yes, she is 35 years old and above with no children for both of us, she's looking to purchase a resale flat after our divorce is completed. Just a question, is her basic 3200$ with the commission and annual monthly income after commision around 6800$, how much loan can she get from HDB? Will they base on basic or the total amount of 6 months combined? thanks

If both you and your spouse are agreeable to the sale to your brother, and your brother's finances are ready, you can do the sale as per a normal sale & buy transaction. That will be a faster way. Do you guys have any children? Is she 35 years and above? Typically need to wait out the divorce court order before she can do anything for the next property.

Hi Sir,

Sorry to hear about your divorce. Your brother will be eligible to take over your flat but we will have to check whether financially he is able to do it taking into consideration the amount of loan he is eligible and the CPF that he has.

As for your wife, she has to be above the age of 35 years old to be eligible to purchase a resale flat or a 2 room BTO flat.

Hi,

1) Your brother is eligible to buy over from you according to the information provided.
2) The procedures are the same as selling and buying.
3) Although this process does not necessarily need an agent, but I would be glad to assist.
4) There are 2 things that need your clarification:
(a) Have you completed the MOP of your current flat?
(b) Have your legal divorce process been completed with a final court order?

5) The transfer can only be materialized when both items in (4) are completed.
6) We will have to appeal to the HDB in order to start the selling and buying process if 4(a) is not completed.
7) Your wife can only buy a resale flat only if she is at 35yrs old or above as a single, or under the family scheme if buy with parents/children or a partner.
8) The buying can only be started after the final court order is issued. Otherwise, both of your names have to submit together in order to be eligible.

    Thanks for the reply and questions.
    1/ What's the total cost estimated if we were to go through a sale process in this case? ( Agent fee, admin fee, etc.)
    2/ Could I sell it to him at the BTO price when I got it or must it be at the resale market price?
    3/ Can I purchase back at the same procedures once I reach 35 or will he need to wait for the MOP to be completed? If yes, is there any way for expediting? Thank you.

    Our MOP will be reaching in a few months' time and we are finding the best option before proceeding with our final divorce.
