Husband owner of HDB passed away leaving his wife as occupier but willed the HDB flat to 3rd party. Got no son or daughter & administrator want to fight it out in court. Since Husband & wife are essential occupier, do the 3rd party have the rights to chased them out?

Afternoon Ronnie,

Under normal situation, where no WILL have being drafted, the spouse will automatically be the legal owner of the unit, provided they fulfill the eligibility scheme set up by HDB. Since there's a WILL, what the surviving spouse can do is to apply through court to contest the case. Being able to provide all necessary documents to support the claim that the spouse have fulfilled their rightful duties will be a lengthy process. If the contest fails and the administrator wins the claim, they do have all legal right to chase the existing occupier/s out of the unit.
