Your husband will need to have his name removed from the current HDB in order to own a BTO with you. This is provided that his mother is eligible to be the sole owner of the existing HDB, and also able to refund your husband any CPF monies that he has used to finance the HDB. If it is not a fully paid HDB, then his mother will need to be financially ready to be eligible for home loan and repayment on her own as only home owners can be borrowers.

Hi Mdm,

You will need to get your husband's name removed from the current HDB flat if your mother in law's intention is to retain the flat. You may approach the HDB branch office for assistance but if he had used his CPF on the flat before, your mother in law will need to return him the CPF + interests.

If your intention is to sell this current flat, then as long as the MOP is met, you will be free to apply for a BTO flat. Please contact me privately so that I can understand your intentions and provide you with further assistance.
