Hi,im a muslim lady processing for divorce,ive got 3 children, my 2nd and my son decide to be with the father and my eldest with me. The matrimonial under both party name but my husband contribute more. We still have oustanding HDB loan. In his affidavit,he request for transfer which i will not agree. Can he get the flat if the 2 children stay with him? Can HDB force me to transfer to him?

Morning Marisa,

I believe under any law, settlements are to be done under ones will and once the marriage is dissolved, both of you are required to sell the unit. If you are not willing to transfer your shares to him, why not get him to purchase your shares instead?
