Hi.I am in the midst of filing for a divorce.If the house MOP is not met, will I need to surrender the house to HDB or will I be able to retain the house till the MOP is met to sell it in the open market?
If I choose to file for separation instead due to the MOP, will Retain the house till MOP be an issue?

Dear Sir/Mdm,

Surrendering the house back to HDB may not be the best option since you may take a hit financially. You may want to appeal to HDB to seek a waiver to sell in the open market.

Hi,

1) You have to find out more about the divorce process in Singapore. My understanding is most cases need to file in separation and wait for a minimum of 3 years cooling period before can bring this up to court, other than certain specific circumstances.
2) After submission to the court, you properly have to wait for another 6~9 months before the final court order is issued.
3) You can only offer an OTP after receive the "Final court order".
4) So all in all, it is going to be 3.5 years later before your flat can be surrender or sell.
5) You will suffer at least 20% off from market-rate if surrender the house to HDB, it could be even lesser.
6) If a "Final Court order" is issued before you meet your MOP, you may write in to HDB for permission to sell in the open market to avoid this unnecessary monetary loss.
