Hi, with no other properties at hand, if I purchase a 4 room flat under my wife's name, can I immediately buy a private property under my name? Is that permitted by the law even if my wife and I don't intend to live in the hdb (hence putting me in as occupier is out of the question)?

Hi,

As a married couple, HDB views both of you as a married entity hence you can only form the family nucleus by applying with both names for the HDB, thus both will be bound by the MOP of 5 years once the HDB purchase is completed. You can't purchase private property within MOP period.

Hi,

If your wife were to buy a HDB flat under her own name, your name will be needed to be put in as the "essential occupier", as she needs to form a family nucleus in order to be eligible to buy a HDB flat. And as an essential occupier, MOP applies and you cannot buy another private residential property within the next 5 years.

Also, take note that no matter whether you are staying in the HDB or not, you are not supposed to rent the flat anytime during the 5 years MOP period, unless you have special approval.

If you're looking to own 2 properties without incurring ABSD and also take up maximum loan, the best option would be to buy a private residential each under you and your wife's name.

As the HDB point of view, married couple would need to purchase HDB under family nucleus, hence you could only purchase a HDB and wait until 5 years MOP then only can purchase for another private residential property.

You will need to be an Essential Occupier if your wife purchase a HDB because both of you are married. Essential Occupiers are required to observe the 5 years Minimum Occupation Period (MOP) as well.

If you are thinking of staying and renting at the same time, you can consider Dual Key condo or EC units (if you are eligible) instead.

Good morning,

As married couple, you and your wife are considered as an entity. If you are looking at purchasing resale HDB unit, both of you have to observe the MOP requirement, even as an occupier. Therefore, both of you have to stay within the HDB unit for 5 years before both of you are eligible for your second property.
