In terms of the existing HDB, it is likely to have a court order indicating how the existing flat should be managed. If it is sold, the individual can purchase and apply for BTO if they are eligible to do so based on the schemes available.

Hi,

Usually it needs to be put up for sale in the open market if the MOP has been met. There will be a court order to confirm what happens to the matrimonial property when the divorce proceedings complete. Whether they qualify for BTO again depends on whether they are able to qualify under the schemes available. I have done similar cases before and will be in a good position to share some advice. Good afternoon,

usually a court order will be issued in the event of divorce to request the couple to sell the flat and how the sales proceeds will be distributed.

As for BTO application, its depends on your eligibility. Under single singapore citizen scheme, one must be at least 35 years old and a Singaporean and if your current HDB is a BTO as well, you will be subject to resale levy for BTO purchase.

Dear Sir/Mdm,

For a divorce case, it is recommended that there is a mutual agreement by both parties to sell the flat in the open market. However, one party may also wish to take over the share of the other party.

For BTO application, you will need to fulfill the eligibility criteria ie. above 35 to be able to apply for 2 room flat. If you have a child and the child is under your custody, you will also be able to apply for a BTO.

Good afternoon,

Court order will indicate how the current HDB unit will be assigned. Either through part purchase or have it marketed in the resale market. The split on the profit or loses will also be indicated.
Once the unit have being sold, only either of you are eligible to purchase a subsidized unit if the current unit have being purchased directly from HDB.
