Hi, We bought our 5 rm hdb flat and given the seller 3 mths extension. We are supposed to get our keys on 13 Feb, but seems like they do not want to move and asking for further extension which we did not agree.

What should we do and what can we do as an owner on that day if they did not move out besides calling the police?

My Answer with regards to your Question:

If the sellers are not complying with the agreed-upon timeline for vacating the property, you may need to take certain steps to address the situation. Here are some actions you can consider:

Check the Contract: Review the terms of the sale agreement, including any extension agreements. Understand the clauses related to possession and any penalties or consequences for delayed handover.

Communication: Communicate with the sellers to understand the reason for the delay and discuss the situation amicably. Express your concerns and emphasize the importance of adhering to the agreed timeline.

Legal Notices: If communication does not resolve the issue, you may need to send a legal notice to the sellers, providing them with a final deadline to vacate the property. Consult with a legal professional to draft and serve the notice.

Involvement of Authorities: If the situation persists, you may need to involve relevant authorities. In Singapore, the HDB (Housing and Development Board) or legal channels may be able to assist. Consult with a legal professional to determine the appropriate course of action.

Document Everything: Keep detailed records of all communication with the sellers, including emails, messages, and any legal notices served. This documentation may be important if legal action becomes necessary.

Consult Legal Advice: If the issue remains unresolved, it's advisable to consult with a legal professional who can provide advice based on the specific details of your sale agreement and local regulations. They can help you understand your rights and options.

Police Involvement: While calling the police may not be the first step, if the sellers refuse to vacate and legal means have been exhausted, you may need to consider involving the police to enforce the possession order.

It's crucial to follow legal procedures and seek advice from a legal professional to ensure that you are taking appropriate and lawful steps. Laws and regulations can vary, and a legal expert can provide guidance tailored to your specific situation.

Dear Alicia,

Am sorry to hear about the current situation. This is an unfortunate incident but yet common problem that surface in this channel on PropertyGuru. Besides reporting to police, I believe your only option is to consult a lawyer on this or see if HDB is able to advise further. Are you aware of why the seller is requiring the extension? Perhaps communicating with them will give you a better idea and allow you to decide what course of actions to take maybe more applicable.

I don't use AI for my responses here and the above is what I encounter from others experience as I have not personally dealt with such situations.

I have been in the real estate business since 2009, with more than 14 years of experience serving the Singapore real estate market.

I am very active in the residential segment of Singapore real estate market, having transacted hundreds of deals from HDBs to private condominiums and landed properties in Singapore, and have handled many unique cases in sales and purchases as well as rental deals.

Over the years, I have also established a network reaching out to more than 9,400 expatriates, bringing my market presence to both in and outside of Singapore. This has created an additional exposure when I manage my client's portfolios, on top of the conventional on and offline platforms, where other estate agents are relying on. This has allowed me to consistently convert leads into results.

With an evolving market, where change is the only constant, I have also been investing in upgrading of my knowledge and skills sets to improve myself and meet the demands of current and future market.

I am sorry to hear of your unfortunate situation. If you have an agent representing you or the seller has an agent, try to speak to them and see if they can assist.

Besides going to the police, you may want to seek legal advice. All the best!
