Hi we are singaporeans. My parents divorced in 2014 after 25 years of marriage. The 5 room hdb flat is a matrimonial asset and has met the 5 years MOP. It is under my dad and mum's name. My mum (the defendant) has sole custody of my sister (we are both 25 years old) and we both choose to live with my mum as my dad is planning to marry other woman. My dad has been living in our house. The court order stated that the matrimonial flat be sold in the open market. But till today there are still no buyers. However on another court document it was stated that 'proposal on matrimonial home to be transferred to the defendant' defendant here refers to my mum. Can my mum retain the hdb flat under her name only? How to remove my dad name from the house? Will we need to pay him back his cpf or can he take out his cpf without us having to repay him anything? If my mum cannot retain the flat under her name only can i put my name as the co owner of the flat? I earn about $5000 and my sister earn $2000
