1) By right this should not happen in the first place. Is there any agent involved in this process?
2) Seller's agent will do a preliminary check on whether the seller has the eligibility to sell.
3) This issue will definitely be raised when the seller registers "Intent to sell".
4) If the fault lies with the seller, you may read the HDB OTP clause 3 Confirmation by Seller. It is written very clearly that the seller has to return the option fee and exercising fee back to the buyer. And the buyer has the right to pursue a further claims against the seller.
5) If there is a dispute over this, you will have to take legal action against the seller and bring them to court.
