Hi there, my parents are finalizing their divorce and my dad is transferring his HDB share to my brother and my mom. He is willing to receive a partial refund of 200k instead of the full amount and this has also been granted by the lawyer and CPF. They still have a remaining mortgage loan of 120k.

Can I check for this HDB application, is it under the sale of part share or transfer of ownership? Also, what is the different between these 2 and in terms of financing the loan? Thank you in advance.

Hi,

1) It is common that sales of part share and transfer of ownership are loosely interpreted and use in the current market.
2) The main difference between Transfer of ownership & sale of part share is former can be non-monetary whereas the sale of the part share must have money involved.
3) In terms of financing, this should be considered as the sale of part share, to begin with. Thus it is a loan above the current mortgage.
4) Household income is the main considering factor for banks or HDB to determine whether they are allowed to provide the needed amount. This is strictly governed by MAS using MSR as a guide.
5) You have to consult HDB or bank dependent on your current borrowing institute, whether their income is sufficient to cover the addition.
6) By the way, your parents have to wait till their final court order before anything can start to process. But can consult with the borrowing institute now so that you are prepared when the final court order is issued.
