Hi there! I’m a SC who lives abroad. I’m thinking of buying a resale flat to rent out or a backup place in case we come for long vacations. My husband is a foreigner who lives abroad with me and has no intention to live in sg. My sibling wants to buy BTO with her partner in few years. My parents already own the current family flat. Any way I can go about purchasing a resale flat at all?

Dear madam,

In terms of eligibility to purchase a resale HDB flat, you should be able to purchase under the non citizen spouse scheme as what Khalil has indicated. The only issue is renting out the resale flat can only be done once you have completed to Minimum Occupation Period of 5 years, where chances for HDB to grant you approval to rent out is relatively remote since you are already residing overseas. In addition, from an investment perspective, HDB flat also do not provide the best return therefore you may wish to consider looking into a private residential apartment instead since it has lesser restrictions in place (if you consider Seller Stamp Duty where property is sold under 3 years from holding as a restriction) where you tend to have a better potential on capital appreciation.

Since you are a Singaporean, there will be no Additional Buyer Stamp Duty imposed if your husband decides to purchase this unit as a co-owner if this is your 1st matrimonial home in Singapore.

Hi,

1) You are legally married, therefore you must buy the HDB flat under the Non-Citizen Spouse Scheme.
2) There are 2 types of requirements on your spouse residence status depending on your age:
(a) If you are below 35 yrs old. Your spouse must have either Long-Term Visit Pass or Work Permit.
(b) If you are at or above 35 yrs old. Your spouse must have either a visit pass or a work permit.

3) In order for you to buy an HDB flat, both you and your spouse must have Singpass ready.
4) Although your husband is not the owner of the flat, as a spouse he must acknowledge you are buying an HDB flat.
5) Therefore it is a strict requirement from the HDB that he needs to acknowledge all the documents submitted by you for resale application are valid and in order.
6) Under such circumstances, you and your spouse will need to return to Singapore to stay for a period in order to get the visit pass and Singpass to prepare for the purchase.
7) You will have to stay longer if your spouse needs to get the long-term visit pass. You will have to visit ica.gov.sg to under more detail about this matter.
8) Direct buying while you overseas seem not an option for you now unless you have both the passes (visit pass & Singpass) readily.

Hi Mdm,

You will be able to purchase a HDB resale flat under "Non-Citizen Spouse Scheme", with your Husband as an essential occupier. However, only your income will be used for loan assessment. Do take note that you will need to fulfill the 5-year MOP before you're able to rent out the entire flat.

If your objective is to rent out the property for rental income, then it would make sense for you to go into private instead. By going private, both you and your Husband's income will be used for loan assessment, and you will need not pay any ABSD as this is your first matrimonial home.
