Hi there, I have the following option to renew clause in my tenancy agreement:

"That the Landlord shall on the written request of the Tenant made not less than two (2) calendar months before expiration of the tenancy thereby created and if there shall not at the time of of such request be any existing breach or non-observance of any of the agreements and stipulations on the part of the Tenant grant to the Tenant a tenancy of the said premises for a further term of one (1) year from the expiration of the tenancy at a rent to be agreed based on the prevailing market rent capped at maximum of $3,400 and upon the same terms and conditions"

Could you confirm that this gives me the right to extend the lease for another year, even if the landlord would rather take the apartment back or sell it?

Hope you have resolved this issue. Technically speaking yes, but if landlord requires to take back the apartment, the negotiation is going to be tough and will not be on good vibes. And I always feel that if you are living in a place permanently, vibes should be good, otherwise you will also feel uncomfortable living in that place. Read More
