Hi, the ec that we currently stay had reached mop. We are looking to move back to hdb. If we would like to keep current ec. Is it possible to apply for a resale hdb using my parent in law name and my husband name?

Dear madam,

Unfortunately no, as you and your husband is considered an entity under HDB's perspective, therefore even if you are not a legal owner of the HDB you intend to purchase, you will still be an essential occupier and will be required to dispose the current EC within 6 months of taking possession of the resale HDB flat.

Is there any reason for the intention to shift back to HDB?

Hi,

Unfortunately no, HDB deems both you and your husband as a married entity family nucleus and hence both of your names are required to be eligible for the HDB resale purchase.

Unless your parents in law can form their own family nucleus to purchase the resale HDB on their own name, then your names need not be included and you can keep the EC.

Alternatively, you can explore decoupling process and use 1 name to keep the EC. The other name freed up can purchase private property (but not HDB on the own name, as not eligible) with or without the parents in law included.

Hi Mdm,

It is not possible to keep your EC and buy a HDB flat using your husband's and in-laws names. This is because both you and your husband are considered a single entity when buying a HDB flat and therefore both your names have to be included either as owners or occupiers. In this way, you will be required to dispose off your EC unit within a 6 months period.

If you wish to keep the EC, you may consider doing a decoupling and use one of your names to purchase a private property or alternatively, you may get your in-laws to purchase a HDB themselves if they are eligible.

I regret to inform you that this is not possible. As long as your Husband's name is used to for the purchase, you will have to be either the co-owner or an essential occupier.

This means that both of you will have to sell off your EC latest within 6 months upon the HDB resale flat purchase.

If you're looking to hold onto your EC or to own 2 properties, you can only look at private properties.

Hi,

1) When comes to an HDB application, a married couple is always considered as a single entity.
2) Both names must be present in the application even one of you as an occupier.
3) So since you own an EC, you will have to dispose of your EC upon key collection of the purchase HDB flat within 6 months.
4) You can't own private property (MOP EC) and buy an HDB resale flat without disposing of it.
