Hi Sir/Mdm I'm asking on behalf of my friend... My friend (Singapore citizen) & his wife (a foreigner) has applied for an BTO flat years back after marriage & everything was approved, just waiting for the keys either this year or next. However, they may be going thru a separation now. Can my friend still keep this BTO unit as he has no flat under his name at this moment. His wife is willing to wait till everything is settled before proceeding to divorce so that he can keep this flat. Can my friend take over alone or together with his dad who has no property too. All agents please kindly advise....

Morning, The BTO unit have being purchased under Public Scheme and the legal ownership is under your friend and his spouse. Under application of BTO, to change the ownership to another person's name, you will have to approach HDB for an answer. As for the private arrangement that your friend and his spouse might have, I would have to say that they are required to sell off the unit or perform part purchase within 6 months from getting the court order.
