Hi our current HDB is under mine and my husband's name. We are looking to buy a second property (condo) for self-stay, and HDB for renting out. Like to know more about HDB decoupling.What are the things to note and what will be the fees incurred?

Good evening investor,

I can send you an email on decoupling from my law coveyancing manager if you are keen.

For instance, if you intend to be the main owner while your husband become occupier. You need to pay him back in cash for CPF OA funds utilised plus accrued interest, pay buyer's stamp duty for the percentage of ownership that is being transferred (50%), financially capable to take up a loan if need be, legal fees etc.

Probably you can share more with me so I will be in a better position to advise you further.

Hi buyer,

I can let my lawyer advise you on HDB decoupling and give you a free quotation, be proceeding to assist you with it.

Basically, whoever takes over the house has to pay back the CPF OA of the other party, and pay the BSD of ~3%. If your loan has been paid fully, you won't have to worry about making any changes to your mortgage.

I have just assisted my client in decoupling their property. For HDB, you will need to satisfy certain criteria, for example your mortgage loan must not be a bank loan.

For the party who is taking his/her name out, the other party will need to return his/her CPF utilised with accrued interests in CASH.

Hi

Decoupling can be applied both on private or HDB properties. However, the rules are more stringent when it comes to HDB property.

It would be advisable that you speak to a lawyer before deciding on decoupling as the mode of transfer can differ depending on whether it's a HDB or bank loan.
