Hi my wife and I have decided to go our separate ways. Are we allowed to sell our resale hdb in the open market (including the reimbursement of the sale proceeds to our respective cpf accounts and splitting of any remaining cash proceed first) before proceeding with our divorce? We already met 5 yr MOP and required separation period.

Hi,

Sorry to hear about the situation. Yes its possible to sell the hdb first if both of you can have some form of written agreement regarding the sale proceeds allocation as well as who to appoint to handle the property sale and the targeted price range to accept. The CPF refund will be according to the respective amounts utilized + accrued interest, and this amount can be retrieved from CPF website, and cannot be disputed. The sale price will go to pay off the outstanding loan, refund your CPF and pay off any legal and agent success fee, and balance will be sale proceeds issued in a cashier order in your joint names.

Yes, it is possible to sell the HDB flat in the open market, as long as you have met the 5-year MOP of the flat.

In fact, selling the flat before you file for divorce is a more "clean-cut" case, as you are not required to wait for the Final Judgement in order to complete the transaction. It will be handled like a normal sale.

Good morning Sir,

yes you are eligible to sell off your resale HDB as 5 years MOP has been fulfilled.

If both of you decide to sell before divorce proceedings, it will be treated as a normal sale thus any apportionment method have to be settled among yourselves cause the sales proceeds will be needed to bank into a joint account.

If you dont want that then you will have to wait for a few months to get the court order/ final judgement before you can proceed with sale.
