Hi, my wife and I are going to divorce soon. We are childless and both age 32. Can we still retain our hdb flat under both our names? We intend to still stay in the same flat until we are eligible to get our own house.

Hi, this will be best to check with your lawyer as it is in regards to matrimonial assets, or HDB. As both of you do not fulfill any criteria to hold the flat once you guys are divorced, it may be a tricky situation where they might require for you guys to dispose of your flats.

Sorry to hear about the situation, I hope you are managing well. Unfortunately once you all become officially divorced, you are no longer eligible to keep the hdb since both are single and not yet 35. HDB will require you to sell or surrender the flat back to them.

    Hi,

    This is usually if one of you found a new partner and re-marry, and want to transfer the ownership from the one of the owners to the new owner. This requires HDB approval and of course, you have to allow the divorce the finalize first. Another scenario is the remaining owner adds his or her parents name to form family nucleus to keep the flat.

    In your case, if you all still intend to keep the BTO, if possible, maybe you all might want to talk it out and choose to work on reconciliation or maintain the current situation first. Once the MOP is met, you all can plan again from there, whether to keep or to sell.

    Hi Ivan, thank you for the response. I read it online that if I am unable to meet the conditions and eligibility requirements, another person may be cited to retain the flat, provided they are eligible under a different scheme. I can't find the scheme online. Are you familiar with that?

It depends on the divorce proceedings as well as final court order. I have encounters for divorcees who have not sold off the HDB for more than a year as well. In fact they are also living under 1 roof like what your intention is. Nevertheless, I am also sure you do not want to fall foul of the law, therefore the best option could perhaps be to wait until the final judgement is out before assessing what the road ahead is, since divorce proceedings can also take a while to finalise.

I have personally handled cases which are similar to your situation. Once the divorce is finalised, HDB will require you to dispose off the flat if the MOP is met. This is because as both of you are under the age of 35 and without a child, you will not be able to form a family nucleus.

After an official divorce, both you and your spouse are considered single applicants.
Neither of you being 35 yet means you won't be eligible to keep the HDB flat.
HDB will require you to either sell the flat or surrender it back to them.
