Hi. My situationisas such:

I'm in the midst of a divorce, with Interim Judgement issued on 5 Jan 2024. FJ should follow 3 months after. I current own an HDB with my wife. Following the FJ, the intent as stipulated is for me to transfer my share of the flat to my wife. We are both Singaporeans. I have 2 related questions:

1. Given the FJ is expected to come in on Apr 2024, am I able move out and to rent a HDB room before the FJ given that I still own an HDB?

2. Based on agreed divorce terms, my wife has 6 mths after FJ to take over our current HDB. Does that mean that I can only start my HDB purchase after the part share is completed? Or it can commence from the moment FJ is issued.

Are you still within your MOP with regards to your HDB? If you have fulfilled the MOP, there should be no issues in renting a room during this period of time while you await the FJ. With regards to the purchasing aspect, this can be tricky since your wife has 6 months to purchase over your shares, although it is mentioned that this should take place in 6 months, which is perfectly fine for you to make a purchase as long as you have the necessary finances to do so, but what happens if the transfer does not take place? This should be checked with HDB instead as it is not within our means to advise in terms of the existing regulations in place.
