Dear sir/mdm,

In the absence of a will, the estate will be passed down based on the intestate law in Singapore. If there is a concern as such, why not arrange for a will to be done where specific instructions and arrangements can be made.

In this instance, it is best to do up a Will as early as possible, and arrange for specific instructions for the nephew to handle the estate matters. My law firm partner can assist on that.

Hi,

1) If your mom didn't make any will, the HDB flat will distribute according to the Intestate Succession Act.
2) Meaning that her children will all receive an equal share of the flat.
3) One of them will be appointed as the executor to deal with all the matters of the flat both legal and non-legal such as marketing.
4) If you wish to get your nephew to assist in settling all the issues in disposing of the flat. Then your mom will have to make a will.
5) The court will appoint your nephew to deal with all the matters of the flat and receive the sale proceeds of the flat.

Hi,

In the event of demise, a person's estate will be distributed in accordance to his/her Will. If there's no Will, the assets will be distributed in accordance to Intestate Succession Act.

Based on Intestate Succession Act, your Mother's HDB flat will be passed to her Husband (if flat under Joint Tenancy and still alive). If Husband is no longer around, the flat will be distributed evenly between all her children.

Should she has intentions of leave her inheritance to her grandchildren, it is advisable for her to draft a Will.
