Hi. My house just MOP last 2 weeks. I wanted a house on my own badly to live with my own family but if my sister refused to sell the hdb next month, how can i obtain a court order for a sale of this hdb property?

Hi Sasya,

Is your sister able to keep the HDB under her own name and her own income? If so, you may wish to consider to sell your ownership share to her at market value so your objectives can be met.

Technically speaking all the owners must be agreeable to the sale and sign on the legal papers before any sale can be approved.

Getting a court order for the sale is a lengthy process. I would suggest that you try to address her concerns and come to a consensus with regards to the sale of the house.

If your sister is eligible to own the HDB under her individual name and has the necessary financial capacity to undertake the loan of this property solely on her own, you can actually work out to transfer your ownership to your sister with the approval; from HDB. Otherwise, it should be helpful to speak to your sister and convey your concerns and desire of owning your own place with your family and seek her understanding in doing so. In addition, it can also be helpful to know her position to before both of you can make a decision together.
