Hi, My ex-spouse arranged rental of our flat during our marriage and the agreement is signed by him and now i am perceeding a divorce with him and the past months rental has been taken by ex-spouse. Now i, as a co-owner do i have the rights to terminate the tenancy with the tenant? Also during the transaction the contract was only signed by ex-spouse, is it a legal way that the owner and co-owner signs the agreement. Please advise. Thks.

It's better to consult your lawyer that handling your divorce case as they know your case better. Legally the Tenancy Agreement is not complete if it's not sign by both parties The contract can be void if challenge by the other parties. Read More
