Hi, my dad just pass on, and the hdb is solely In his name, I'm married and own my own hdb. My sister is not and under 35. So how would the hdb be split if no will. As I own a hdb I can own my dad. Can my sister use her cpf to buy my share?

Assuming if either one can come to a conclusion of resolving, can I apply a lawyer to sell off this and split the money?

Hi Sandy,

Looking at the situation that you have, I had come across a similar case to one of my client's house. First, I suggest you and your sister go together to the hdb branch office to inform them about your dad's house sitution. Next, as there is no will, you need to get a private lawyer to be involve in this transition. They will assist to get your dad's name to be transfer out of the house. Afternoon Sandy,

If your dad do not have a WILL, the first level of unit allocation is to your mum. And if your mum have also passed on or your dad is a divorcee, the both of you will inherit the property. Grant of Probate need to be attained. Now here comes the tricky part:

1) According to your statement, you are married and currently own a unit under your holding. Your sister is single and under the age of 35. With such combination, you only have the following options:

a) Your sister cannot purchase over your share of the unit as you and your spouse is considered as one entity. She's below age of 35, hence not eligible to take over your day's property as the rightful owner.
b) You are not eligible to take over the unit unless you have the intention to sell off your current unit.
c) With the status stated above, what you can do is write into HDB to request for the transmission to be done. Notify IRAS that both of you have inherited the unit and have the intention to sell off the unit. Waiver of SSD is required. When all is done, engage a salesperson to market the unit and split the gain as per court order.
