Hi my cousin who own 2 Flexi Room with short lease just passed on recently. Can his brother take over silently without informing HDB till the lease is up? Is there a penalty for not informing HDB? Is there a legal way to take over? Appreciation your advise n thank you.

Any takeovers of the flat has to be approved by the HDB. You should check with HDB directly on the potential of having your brother takeover the flat in this case. Read More

As per HDB guidelines, a short-lease 2-room Flexi flat cannot be sold in the open market. If the owner no longer wishes to live in it or become ineligible to do so, the flat must be returned to HDB. HDB will then pay you the value of the unused portion of the lease when you return the short-lease 2-room Flexi flat.

In any case, HDB will eventually find out on your cousin's passing, and may indeed penalize your brother for taking over the flat without permission.

Once the notice of death of the owner is lodged, I believe HDB branch will become aware of the ownership status and might reach out to the relevant family members to process the return of the flat to HDB. I do not think his brother can just silently take over and hdb officers would eventually reach out to work out something with the relevant family members and him as well.

1. According to HDB rules, **short-lease 2-room Flexi flats** cannot be sold on the open market. If the owner passes away or becomes ineligible, the flat must be **returned to HDB**, which will compensate for the **unused lease value**.
2. If your brother took over the flat informally after your cousin’s passing, **this is not allowed**. HDB will be notified once the **death is registered**, and they will review the occupancy and ownership status.
3. HDB is likely to **contact next-of-kin** to begin formal return procedures. Quietly taking over the flat without approval is a breach, and **penalties may apply** if done without transparency or permission.

Hi,

1) There are remaining lease value on this flat which supposed to return to the HDB after the leaser passed on.
2) The remaining value will be distributed to the beneficiairies according to intestate succession act if there is no will.
3) The beneficiaries should perform the necessary legal action to get a letter of administration to submit to the HDB.
4) The attempt to occupy an HDB flat which supposed to return to the HDB is not a wise choice.
5) This infringement will cause trouble to the brother, which subject to fine, or jail, or both penalty.
