Hi, my boyfriend owns a HDB Flat fully paid. May I know can he transfer 50% of ownership to me without monetary consideration if we get married.

I understand I have to pay whatever outstanding if any to HDB like previous levy ( I sold a Flat before) and I am ok with it. Alternative is, I apply another BTO Flat 2 room flexi ( I am 55 yo) and still pay the outstanding levy, however we will not be able to ROM and if one passes away, the other person has no rights to his property and finances.

We do not wish our property or finances falls into another person's hand. Need advice as I have actually secure a queue number for SBF and awaiting for first appointment. Thanks.

Hi,

1) Transfer without monetary consideration is only possible if your boyfriend paid the flat using only cash.
2) Once there is CPF involved, he has to answer to the CPF board.

4) Regarding resale levy, you may refer to below for detail:

5) Do note that in order for the other party to inherit the property according to the deceased wish. You don't have to rely on the Intestate Succession Act. You can make a legal wish so as the surviving party can still inherit the property without difficulties.
6) Thus you don't have to be legally related; i.e. married, to inherit the property.
7) In this way, the cost of making a wish (less than $500) will be cheaper than doing the transfer and pay the buyer stamp duty which is going to a few thousand.
8) In this way, your boyfriend's flat can rent out for passive income while both of you stay in the new BTO 2-rm flat.

Hi Property Buyer,
Since your BF owns a HDB, you can go through ROM and be a couple. He can add you as an occupier, in his will and as a CPF beneficiary too. However, if you want to purchase a property in your own right, I would suggest you buy a private apartment. This way, you do not pay ABSD.

Further more, you can also rent out one of your properties for passive income. Many HDB home owners would love to be in your position as they want to buy a 2nd property but having to fork out 12% ABSD makes many decide not to.
