It depends on the divorce proceedings and whether any agreement on the treatment of the matrimonial property. Also depends on whether you can take over financially based on your finances and sole income. Is this property a hdb or private property?

Sorry to hear about your situation. If you have yet to commence divorce proceedings, it would be best to think ahead, prepare your position and start collating any necessary documentations for potential disputes down the line.

You might be better off settling it via mutual agreement than letting the 'system' decide.

Sorry to hear what you’re going through. In cases like this, a lot depends on the flat type, how it was purchased (e.g. under a family nucleus), and whether you meet eligibility under the Single Singapore Citizen Scheme once you turn 35.

If the divorce happens after you turn 35, there’s a better chance you can retain the flat under your name, subject to HDB’s approval. But if the divorce is before you hit 35, it’s usually harder unless there are exceptional circumstances — you might need to appeal.

Hi,

1) If you have an agreement with your spouse that she has no objection for you to buy over her shares.
2) Both of you may include this under your agreement, the court will indicate this under the interim court order to minimise any conflict in the later stage.
3) You have to be 35 yrs old by the time the final court order is out. Otherwise, the HDB can reject your application to buy over the share, and command to sell it in open market, or they will take back at a lower rate than the market.
4) In general, it takes about 9 months from the lawyers submit document to the court to get the final court order.
5) It is around 3 months from interim court order to final court order.
6) So, time the processes carefully with both lawyers to work out the best timing for both of you.
