Hi, kindly advise as follows:-

Party A & Party B owned a 4-room HDB (already fully paid with no outstanding loans) under joint tenancy.

Is it possible to change to “Tenancy In Common”?

- If so, who has the right to request for the change? (flat was 3/4 paid by Party A & 1/4 paid by Party B).
- Will it be handled by HDB or a lawyer has to be engaged? - Is there any way to transfer the ownership of either party to the children (already > 21 years old).

Hi,

(1) Yes, it is possible to make such change regardless of whether fully paid or not.

(2) Both owners have to agree to such changes.

(3) Lawyer has to be engaged, agreement must be signed between both parties. HDB will not want to get involved in such arrangement, only process the paper work.

(4) Same answer to (3).

    Can I also know whether both parties have to be divorced in order to proceed with the change?

    If both parties agreed, does the children has to return the 3/4 amount paid by Party A?
