Hi, if I own a HDB flat and I inherit my parents' condo and HDB flat,
(1) must I sell my parents' condo and HDB flat if my HDB flat has not met MOP? will HDB make an exception for me to sell the new not-yet MOP flat if I prefer to keep the inherited condo and HDB flat?
(2) if my HDB flat has met MOP, must i still sell it within 6 months since i will be inheriting my parents' HDB flat and you can only own 1 HDB flat at a time? Are there exceptions to this, e.g. if my parents' HDB flat was bought before a certain date?

These are really good and important questions — inheritance cases can get tricky, especially when it involves both private and public properties.

If your current HDB hasn't met MOP, HDB typically doesn’t allow you to hold or buy another property (including through inheritance), and they may require you to dispose of the inherited property instead of the HDB. Exceptions are rare and case-by-case — HDB is quite strict here.

If your HDB has met the MOP, and you inherit another HDB flat, you’re right that you generally must sell one within 6 months, as you can't own two HDB flats. There are some rare exceptions (e.g. if the inherited flat is a pre-1989 non-upgraded flat with no CPF used), but it’s very technical and you’d need confirmation directly from HDB.

These cases depend heavily on the timeline, flat types, and policy interpretation — best to get personalised advice to avoid any costly missteps.

1. If your flat has not met the MOP, you will not be able to keep the flats and the condo. HDB will need you to dispose them in the open market.

2. For HDB flat, you and your partner can only own 1 HDB flat as a family nucleus and there is no exception. Therefore you will need to choose which one to keep and which one to sell. You will be able to inherit the private property if your MOP is met.

The impression I here here is that you should be required to sell off the condo since your HDB is still under MOP, but it will still be best to check with HDB.

Your scenario is a bit unique so perhaps the hdb officers will be the best party to clarify for you. But you will definitely have to sell one of your HDB flats, and have to approach HDB branch to discuss with them which you would like to keep and whether its feasible. Technically you can only keep the private property after your MOP of flat is met. May I know how long to your MOP being fulfilled?

Hi,

1) There are few facts you must be aware and comply when the time comes:
(a) You can only keep one HDB. You have to decide either to sell your current flat or the inherit flat.
(b) If you have not met your MOP, you will not be allowed to keep the private condo.
(c) If you have met your MOP, you can keep the condo for rent as a passive income.
(d) If you decide to keep your parents' flat and sell yours. You will not be able to keep the condo in the process. This is because you have to fulfill MOP of the inherited flat before allowed to keep the condo. Since this is impossible to fulfill, you will have to sell the condo.

2) I have explained the consequences on 1(c).
3) Singapore has no inheritance tax now. So, you are not subject to any BSD and ABSD.
4) You will have to engage a family lawyer to assist in your inheritance whether there is a will or no will. This is a must and no exception to complete the legal takeover of the property.
