Under your situation, your application will still consider as 1st timer priority.

There is no difference whether apply for bank or HDB loan pertaining to resale levy.

Resale levy is based on last sold subsidized flat size sold on or after 3 March 2006:
3-rm: $30k
4-rm: $40k
5-rm: $45K
