Hi, I would like to buy a resale flat this year. My preference is to stay beside my primary school and there are no condos nearby that I like.
However, I have a property overseas that I want to dispose of, but am unlikely to be able to do so until 2025 due to local laws barring sales until then. I am also appealing there to transfer ownership early to a family member there, but the outcome of this appeal will likely take some time.
I would like to make an appeal to HDB, in the knowledge that I may not be able to get rid of it within six months of completing my HDB transaction, but in good faith I will get it transferred away as soon as legally possible over there.
May I know if the appeal process starts after already buying the HDB flat or before I even start the purchase process? If it starts only after I have collected my keys here, and my appeal is rejected, what would happen?

it will be best to obtain appeal before purchase. But do take note the appeal is based on a case by case basis.

Hi,

1) The 6 months period starts on the day you collect keys for your HDB purchase.
2) The HDB will let you sign an undertaking letter on the completion day. On it will state the due date to dispose of your overseas property and other detail such as whether exercising the option of your overseas property is counted as sold.
3) The repercussions of failure to comply with your undertaking are serious. The worst can be confiscation of your purchase, fines, jail terms, or all of the above.
4) Therefore this is a serious matter that you should get an In-Principal-Approval of not being able to get it done within the stipulated period.
5) If your appeal is rejected, it is best that you dispose it of before you plan for your purchase.
