Hi, I rented a condo along with my sibling and I'm listed as the occupant in the tenancy agreement. I do not wish to continue renting. I do not liaise directly with the agent nor the landlord. However, my sibling would want continue due to the hefty penalty and threatened that I should continue paying for that room and that I'm also part of the TA and I should be responsible. I'd like to terminate this entire thing because this sibling of mine is too much for me. Does the tenancy agreement affects me if I choose not to continue contributing to the rent. I have done my part in persuading her to terminate and wiling to pay the hefty sum but it seems like she isn't willing due to the optimal location of the rented property. How should I go about in such situations and what should I be aware of.

Hi, both of you are parties involved in the agreement, and both of you are liable and responsible for the agreement. The one alternative solution i can think of is liaising with the landlord as well as your sibling to have a replacement tenant to take over your room and see if they are open to the idea.

Hi Jermaine,

It would be better to work things out with your sibling. Tenancy agreement cannot be terminated as you wish. If there is no provision for your sibling to terminate the tenancy prematurely, there will be hefty penalties involved should the landlord decide to go after the tenants. Am unsure of the actual situation on how both of you decide to rent this place, with her as the main tenant and you only the occupant, but if this matter is being escalated to be a legal issue, it will be the best for you to speak to a lawyer instead.

Understanding Your Situation:

You share a condo tenancy agreement with your sibling, but you wish to terminate the lease and move out. Here's a breakdown of the situation and some options to consider.

Challenges of Terminating the Lease:

Joint Liability: Since you're both listed as occupants on the TA, you're jointly liable for the rent and fulfilling the lease term. This means your sibling can't unilaterally terminate the lease without the landlord's agreement.
Options to Explore:

Negotiate with Landlord (Together):

Approach the landlord together and explain your situation.
See if they're open to early termination with a penalty (if applicable in the TA).
Perhaps your sibling can find a replacement tenant to fulfill the remaining lease term, potentially reducing the penalty or inconvenience caused to the landlord.
Negotiate with Sibling:

If option 1 isn't feasible, discuss a solution with your sibling.
Could they take over the entire lease and find a replacement for your room, freeing you of your financial obligations?
Be prepared to compromise financially to reach an agreement.
Explore Break Clause (if applicable):

Review your TA carefully. Some leases have a break clause allowing early termination under specific conditions (usually with a penalty).
If a break clause exists, explore its terms and see if it's a viable option.
Important Considerations:

Financial Implications: Terminating the lease early might involve penalties outlined in the TA. Be prepared to potentially cover your share of the penalty or remaining rent if no solution is reached.
