Hi, I intend to buy a resale HDB flat and sell my condo apartment.
I have never owned any HDB flat before. Do i need a lawyer to perform the purchase or can I conduct the purchase directly with seller/HDB?

Good morning,

If you plan to take bank loan for the HDB purchase, yes you will need to engage a law firm to handle the conveyancing. Regardless, for the condo sale, you will need to engage a law firm to handle the conveyancing. Do note the condo will need to be sold within 6 months after the resale completion of the hdb.

1. You can purchase HDB from direct owner (if you meet the HDB eligibility conditions to buy a resale flat )
but you will need to engage a lawyer to handle the conveyancing, either HDB lawyer or private lawyer
2. It will be good to know the current market value of your house before selling.

For both the transaction of the purchase of the HDB flat and sale of the condo, you will need lawyers to assist you in the conveyancing. This is compulsory. For the HDB flat purchase, it is possible to engage a HDB lawyer which is at a lower rates, however, for the sale of the condo, you will need to engage a private lawyer.

It is important to time the purchase and the sale concurrently so that you will not need an interim place to stay during the transition. Hi,

1) You may do your own sourcing and sign an OTP in an HDB flat purchase from an owner directly.
2) I would like to highlight that it is best you verify the legal ownership and check whether the seller is not secretly an undischarged bankrupt.
3) It is best to find out whether are there any essential occupiers in this property and they are giving the consent to sell. Otherwise, you might entangle in a family affair and be unable to complete the transaction in a smooth manner.

Why Lawyer is needed:
4) However you will still need a lawyer to perform the legal transaction.
5) They are the ones that should go through the terms and conditions of your contact and advise you.
6) They have to send out the legal requisition to 9 government arms to make sure your future home not going to be replaced by any government buildings/structures.
7) After receiving replies from all these government departments, they have to understand what are the implications to your property and advise accordingly.
8) They are also the ones to write into the CPF board to request for fund release on the down payment, amount to be paid for the monthly mortgage, pay stamp duty to IRAS on time, etc.
9) Even when you are buying an HDB flat (BTO/SBF) from HDB direct. You will still need to pay a legal fee to the HDB lawyer for the paperwork they performed.
10) Most people are not aware of this because usually, they are paying the lawyer using the fund from the CPF account. No hard cash was dug out from their pocket or also because it was too long ago from their purchase. Thus most of them have no memory of this.

Buy an HDB flat:
11) To buy an HDB flat, you have to check on the eligibility scheme listed by the HDB to ensure you are allowed to buy and own one.

12) If you need financial assistance in this purchase, it is also advisable for you to check whether you are eligible for the HDB loan. Should you consider it if you are eligible to have one.

13) To start your HDB purchase, it is best you start with the registration of intent to buy on the HDB website. This application is valid for 12 months to ensure you have ample time to search for your new home.

14) You are only eligible to buy a resale HDB flat for now. You will only be eligible to apply for BTO/SBF from the HDB after observing a 30-month wait-out period upon selling your current condo.

Hi,

For HDB purchase, if you're taking up a bank loan for it, you will need to engage a conveyancing lawyer to assist you. If you are intending to fully pay for the flat, then you can engage HDB to do the conveyancing for you. You will not be eligible for HDB loan as you currently own a private property.

For your condo sale, you will need to engage a private lawyer to act for you in your conveyancing.

In my opinion, Timeline planning is very important, as apart from the transfer/movements of funds from your sale proceeds for your HDB flat purchase, I believe you would also want to avoid the hassle of having to shift house more than once during this transition.
