Hi, I have recently submitted my resale application, and the seller's agent told me that the buyer might need the extensions. Before the application submission, the agent told me that we would settle it privately and the seller would pay me rent or deduct from the remaining outstanding balance; hence, we did not file for an extension on the HDB portal. On the same night, I did some reading, and I messaged the agent the next day asking about the actual arrangement because it is illegal for me to rent out the whole unit. Should the seller intend to stay for another 2 months, I can only rent out the rooms, which is also illegal because the minimum lease is 6 months. The agent then became unfriendly and told me that I should let them stay out of goodwill (buyer waited for me to exercise OTP in July) at no cost, which I told him that was not possible because I need to pay the installment and rent concurrently. My concern is if the seller delayed endorsing the resale documents, which could potentially result in the application being voided. What can I do? Thanks

Hi Olivia,

1) Personal view is if the agent is aware of the extension needed, this should have been brought up for discussion rather than trying to hide.
2) If the seller did gave a grace period so as for you to exercise the OTP at a later timing. You could also return the favor back out of goodwill.
3) Sometimes it is difficult just to take and not to give in the real world. We have to give and take somewhere.
4) You are absolutely right trying to follow all the rules and regulations spelled by the departments and country. This is so we do not land ourselves into a problem. But things just happened that are not totally under our control.
5) To minimize further damage, it is best you could have a face-to-face discussion with the seller to have a confirmed date you can takeover rather than continue crying over spilled beans.
It is always to your advantage when you can keep a healthy relationship with the seller.
