Hi, I have HDB flat under my name (it was bought with my bro and he transferred to me when he got married). As I am married, HDB said must put my husband name as essential occupier.
Due family situation, can my husband buy his own HDB flat ?

Good morning,

A family nucleus should only own one HDB at any point of time.

As you are married, thats why HDB requires your husband's name to be added into the HDB minimally as essential occupier.

If your husband wishes to buy a HDB, he has to buy it with you as a co-owner or essential occupier.

Nope, husband and wife can own only 1 HDB flat, whether they are co-owners or 1 of them is only an essential occupier.

Hi,

1) A married couple is considered a single entity in the eyes of the HDB.
2) This was the main reason why you see a married couple around you only own one HDB flat instead of two.
3) So, there is no way your husband can buy another HDB flat on his own when he declares married in filling up the HFE.
4) Both of your names must be in the HFE application when any of you want to buy an HDB flat.
5) Your flat must be sold within 6 months upon key collection of the purchase.
6) The other thing you must check is whether you have bought over from the brother for more than 5 years (MOP). There is an MOP (5 years) to be fulfilled as well when a part-share sale is done.
7) You won't be able to buy with your husband if you have not completed the MOP of the current flat.
