I have a 3 bedroom condo fully paid with my husband. Can I decouple from the 3 bedroom condo, so my daughter can transfer her 1 bedroom condo (fully paid) to me. This is because she want to buy another condo and does not want to bear the ABSD.
How is the decoupling process done?

Hi,

For the decoupling process, the main thing to take note is whether your husband, the remaining owner, is able to finance the property under his own sole name, and he is also required to refund the CPF you have utilized for current property, before you can exit. The relevant stamp duties are also required to be paid.

We have to work out the sums to see whether the numbers make sense to justify the 2 operations. It would be ideal if I can have some numbers to work out the scenario.

Dear sir/madam,

Have your family considered a more straightforward option of selling off the 1 bedroom apartment which your daughter own instead of going through the decoupling of your existing 3 bedrooms unit (2 legal transactions - 1 for the your husband to purchase over your share and 1 for you to sell your share to your husband) as well as another 2 legal transactions of the transfer of your daughter's 1 bedroom to you.

Not only that, stamp duties are also applicable for both these transactions on the purchasing part.

If you have utilised any funds from your CPF for the 3 bedrooms unit, your husband will also be required to return this amount back to your CPF (including accrued interest) in order to decouple, and similarly for your daughter's apartment, you must also return the amount she has utilised (if any) from her CPF inclusive accrued interest.

It will be prudent to look into if the 1 bedroom unit your daughter own is good to keep in possession or does it make sense to liquidate after doing the above sums.

While your daughter might be able to purchase a new property without paying the ABSD, is that the most efficient ways of doing so? There are times where decoupling will actually cost much more. For example, the method you mention will actually incur a few BSD. Thus, it will be good if we can discuss further to see what is the best option for you.

Hi Mdm,

As both the properties are fully paid, you can consider the option to decouple. However, you will still need to refund whatever CPF funds used on the properties to the original owner. For your case, your husband to refund to you, and you to refund to your daughter.

Also, take note that BSD is also applicable for such transfers, and you will need legal conveyancing for all parties involved in any transfers.

Whether it makes sense to do the transfers, depends on various factors. May I know how much is the quantum of the property your daughter is looking to purchase? And also the property values of the 2 properties you are looking to transfer?

This is a possible solution but you may have to calculate the cost involved to see whether financially viable because there are legal fees and stamp duty when you do a decoupling and when you take over the property from your daughter.
