hi, i am staying overseas and PR renewal got rejected. PR is till oct. i own a hdb flat within MOP. its given for rent now. i topped up my CPF till now. can i come down to singapore personally before the PR expiry and appeal for PR again or contact hdb to permit me to sell the flat in the open market? or seek a job urgently and apply again for PR before expiry... pls advise.

Dear Anny,

You might like to try appealing to Immigration & Checkpoint Authority especially if you have the intention to relocate back to Singapore and work here.

Summarily, if your PR is not renewed, you would be required to dispose of the flat.

HDB ownership depends on the PR status and if by any means you do not hold PR status you will have to relinquish the HDB ownership.

Following are the options in such scenarios -

1.) You can transfer the HDB on someone else's name (your relative or someone trustworthy).

2. You can sell the HDB in open market.

3. Worst case HDB will take back the flat either on the evaluation or Purchase price whichever is lower at that time.

4.) On the case to case basis ICA can extend you a Visa to sell off your flat for 3 months maximum and HDB will also give you grace period to maintain the ownership during that period.

    Hi Mike, thanks for your reply. Is it really necessary for me to return back to Singapore before 2 mnths of expiry? I resigned here and am planning to come back in September 1st week with the new job joining. As the PR is rejected when applied online, I would like to apply again personally after seeking job there. Shall I get my family too at the time of renewal? or will it work if I apply of their behalf as they r dependant on me. Thanks a lot for ur advise.

With your statement, your choice of allocating out of Singapore is by Will? If so, are you still contributing to Singapore economy beside getting the perks of renting out the government housing for extra income? I would say the answer is quite clear which resulted in your current situation.

By coming back in and getting an employment may not work as ICA requires more than 2 months of employment record to decide your PR extension? As your unit is still within MOP, and by losing your PR status, your might need to write into HDB to have your unit marketed in the open market as they have the rights to repossess your property.

As of the moment, try your luck with ICA and HDB and hope that all things goes well for you.

If your PR renewal has been rejected and your PR status expires soon, here’s what you can do:

Appealing PR Rejection: You can try to appeal the rejection, but appeals are rarely successful unless you have new, strong grounds. Coming down to Singapore to appeal is possible but won’t guarantee approval.

Selling Your HDB Flat: Since your flat is still within the Minimum Occupation Period (MOP), normally you cannot sell it on the open market until MOP is completed. HDB usually does not grant exceptions easily, even if your PR status lapses. You should contact HDB directly to explain your situation and ask for their guidance.

Reapplying for PR: You can try applying for PR again, but processing takes time, and there is no guarantee of approval. Getting a local job may help your application, but the PR must be approved before your current status expires to maintain PR benefits.

Since your PR is valid until October, use this time to sort out your plans. It’s best to get professional advice or contact HDB and ICA directly for your case specifics.
