Hi, i am SPR just converted to SC recently with my son and my husband is still SPR. We just done decoupling our private property and intend to buy new property as our family expanding and we plan to rent out the private property that currently own solely by my husband. Can i check if i am eligible to buy resale HDB flat?

Hi,

Unfortunately no, to be eligible for resale HDB both you and your spouse name needs to be included, which means the private property needs to be sold, and will be against your objective. You can purchase a private property on your sole name not an issue. I can assist on how to structure that with minimized costs.

Sorry, if you want to buy a resale HDB, you and your husband cannot own a private property in each other's name. If you are thinking of buying a resale HDB, you need to dispose of the private property owned by your husband. On the other hand, it might be better to buy another private property if you can afford it.

Dear madam,

No, you are ineligible to purchase a resale HDB if you have the intentions to keep the current private property even though decoupling has been completed. Your husband will be required to be named as an essential occupier for the HDB therefore he will also be required to dispose his ownership in the condo within 6 months from taking possession of the HDB. The 5 years Minimum Occupation Period will be applicable on both of you.

Hi Mdm,

You will be eligible to buy a resale HDB flat however by doing so, your husband will need to sell off his private property within a 6 months period as he will need to be included in the HDB flat either as an owner or an essential occupier to make up the family nucleus.

Therefore, this may not be the best approach. You may want to consider getting another private property under your name since you are now a Singaporean and do not need to worry about ABSD for your first property.

1) The sequence of owning both an HDB flat and a private is; to own the HDB first and then buy the private residential property upon meeting the MOP. And not the other way round.
2) When buying an HDB flat whether it is BTO or resale, both yourself and your husband's name must be submitted as a single entity.
3) Your current options are as follows:
(a) Buy BTO: You have to wait for 30 months after your husband sold the current private residential property before being eligible to apply together.
(b) Buy resale HDB flat: Your husband has to sell the current private residential property within 6 months upon key collection of the HDB purchased.
(c) Buy a private residential property: In this case, you are allowed to keep both private residential properties.

Congratulations on attaining your Citizenship!

As you form a valid family nucleus, you're free to purchase a resale HDB flat under Public Scheme.

Do take note that should you purchase a HDB resale flat, your Husband will be required to be either a co-owner, or an essential occupier. This means that both of you will be required to dispose off all interests in private properties (local and overseas) latest within 6 months of the HDB flat purchase. Both of you will also be required to serve a 5-year MOP for the flat before being able to purchase another residential property.

As you had just done decoupling, do take note that SSD may be applicable should he dispose off his private property within 3 years.
