Hi I am Mr Chan, currently, I am staying in a 5-room BTO flat. This BTO is under my name, my parents’ name is under occupier column. We have stayed in this flat for almost 3 years. Due to my parents relationship is very poor, and my mother does not want to stay with him anymore. My question is: can my father get a single scheme flat, after he divorced my mother, and remove his name from the BTO flat ? Having removed my father’s name in the occupier column, can my mother and I continue to stay in the 5-room flat ?

Hi Mr. Chan,

Sorry to hear about the situation, I hope you guys are managing well. Has the MOP of 5 years already being fulfilled? If so, if going through divorce proceedings, you need to apply to HDB to confirm you can keep the current flat under just your name and your mother's name, as its still within the MOP period.

As a divorcee, your dad can purchase a resale HDB under the single name no issue.

Hi,

I'm assuming all of you are SC for the below answers:

1) Both your parents should be classified under essential occupier unless you are married. Then your spouse shall be the essential occupier instead of your parents.
2) Once the final court order is out on your parents' case. You can appeal to HDB to remove your father's name from the occupier list. This is not a problem.
3) With your mother (divorced) and yourself (even if you are younger than 21 yrs old) already form a family nucleus even if you are not married. Thus continue staying there is not an issue.
4) Your father is eligible to buy an HDB flat under Single Citizen Scheme.
