Hi I am going to extract final judgment on 26th July 25 However my interim judgement never stated about our HDB flat. I went to apply HFE letter with my interim judgement and has been rejected due to HDB flat is still under 2 name.What can I do now.What happen if my final judgment never stated the HDB flat.My husband wanted me to trf ownership to him and he will pay me a sum of money to buy a 2 room BTO flat.However HDB needs final judgment to state in court order.I do not have a lawyer as I apply divorce online.What should I do?

HDB will exclusively recognize the Final Judgement as the official documentation for divorce.
It would be wise to consult with your lawyer regarding the agreed situation for the matrimonial flat, whether it involves selling in the open market or executing part-sales to your ex-spouse.
Once the part-sales application is submitted, you will be able to determine your eligibility to buy your next HDB unit, with the HFE Letter.

In the judgement, there should be instructions on the assets distribution. It is recommended that you engage a lawyer to handle your divorce for you to best protect your interests. It is important to have agreements stated down in black and white so that it can be enforced thru the court in the future.

Without it, you may face more delays or rejections when trying to transfer ownership or apply for a new flat. You might want to approach the Family Court Registry or seek basic legal advice (some organisations offer free legal clinics) to request an amendment or supplemental order that includes the HDB arrangement.

Hi,

1) There are nothing can be done until the final court order is out.
2) Your spouse has to apply for an HFE once the final court order is released.
3) He has to state that he wished to execute a part-share purchase in the HFE. The HFE will determine how much he could loan more on top of his outstanding loan.
4) It is only fair to you that you should sell your shares to him at the market rate.
5) Go through the normal process of selling, submit an intent to sell on web.
6) Negotiate the price and issue an OTP, follow by submitting for a valuation as per normal sales.
7) If the valuation is too much higher or lower than the expected. Both of you can negotiate to determine the final price and re-issue a fresh OTP after the existing expire.
8) After the new valuation result is out, exercise the OTP as per normal and follow the instructions from the HDB.
9) You should also apply for an HFE at the same time when the final court order is released if you are eligible to do so.
10) The HDB will not interfer on whether you are selling the whole flat or doing a part-share since it is not stated in the court document. They will request for both the interim and final court order for their filing.
