Hi, hope you can help me.

I owned (purchased) a HDB shop with living quarters upstairs in1997. Its was used all these years to run my business. I am staying in a private landed property.

I am looking to buy a condominium of convenient location, with a view to sell my present private landed property. I understand HDB had some new regulations forbidding HDB owners to buy private property unless they first sell their HDB flats. I would like to seek your help to the below questions:

1) Is my HDB shop with living quarters upstairs considered residential property ? or shop ?

2) Am I affected by this new regulations?

Would appreciate your kind clarification.

Hi Alan,

HDB shop house is considered as a private commercial treaty so you are not effected by the new regulations. I agree with Joel that you should sell first to avoid paying the ABSD.
