Hi hope u can help me with my query.
the rental unit I’m staying has a toilet leakage which causes the unit below me problem. After inspection, management confirm it’s due to leakage fr my toilet unit.
Owner have to hack down whole toilet for 7-10 days for fully
Reconstruction which will cause great inconvenience to me as tenant. In such case, is it possible to get owner to pay for my cost incurred if I choose to stay away from my home during toilet renovation? And what can owner be liable for?

Hi,

It dependent on whether you had rent a whole unit or room rental.

For room rental, in general, TA is pretty simple thus lots of items are not covered under TA. This shall dependent on both landlord and tenant to discuss to arrange for a solution where both parties can agreed upon.

Whereas for unit rental, it depends on how comprehensive the contract is draft. Some of the clauses mentioned below have to take note of:
(a) UNTENANTABILITY LEADING TO SUSPENSION OF RENT:
This clause usually covered damages due to act of God or any circumstances which is not due to human negligence, where tenant has the right to stay for free during the period of repair.

(b) UNTENANTABILITY LEADING TO TERMINATION OF RENT
Similar to above causes, tenant can serve notice by writing to terminate the tenancy agreement. At the same time, collect back deposit and period of unfit to stay rental amount.

(c) REFUND OF PRO-RATED COMMISSION
Do take note of this clause, where landlord has the right to collect in proportion of salesperson pro-rated commission due to early termination of tenancy agreement.

There are only clause on damage recover but not compensation.

Thus unless your TA covers additional clause mentioning on landlord liability, you do not have the right to claim compensation, but you may claim discount from rent during the period of repair.

So all-in-all, please check the TA carefully whether the above clauses are included to understand where do you stand in terms of legal.
