Hi,

As long as he is 35 years old single singapore citizen, he can purchase resale hdb on his own name no issue. Technically he is not allowed to rent to you during MOP period, and can only sell to you after MOP. As long as hdb policies do not change drastically, and the sale is done on market value after MOP period and relevant stamp duties paid with relevant legal documentation, I don't see much of an issue, just that what is "fair" between you and family can be a sensitive issue since finances are involved.

Hi Mdm,

You will need to take note of the Seller's Stamp Duty when you are selling off the condo since it is still under construction. Secondly, you will need to check whether your brother is eligible to purchase a HDB under his sole name ie above the age of 35 years old and whether is he able to secure a sufficient loan for the purchase.

It is fine to purchase the HDB from him in the future but you will need to incur the stamp duties and legal fees twice if you do it this way.

Hi Mdm,

Firstly, if you were to sell off the BUC condo, you may be liable for SSD if you had purchased it less than 3 years ago.

Secondly, your brother would have to be a Singapore Citizen aged above 35 to be able to purchase a HDB resale flat under his sole name.

Thirdly, he will need to serve the 5-year MOP before he's able to sell the flat to you. Afterwhich, you will need to serve another fresh 5-year MOP.

By doing the above, it will mean that it will be 10 years gone serving the MOPs. And you will have to incur BSD twice on the same flat. I believe there has to be a better solution for you.

Hi,

1) You don't have to use your brother's name to purchase a resale HDB.
2) You are allowed to buy under your name as per normal. You only have to sell off your condo within 6 months upon the key collection of your resale HDB.
3) Your brother's name might not be able to use if your mother is widowed, he might be the essential occupier in the current flat.
4) Only thing you have to ensure you have passed the Seller Stamp Duty period of 3 years for your condo.

Hello there...

I think you already know that it makes sense to sell your condo after 3 years to avoid SSD.
You would also know that your brother needs to be 35 years old to buy HDB resale. So I don't have to tell you this.

Yes your brother can welcome you to stay at his place temporarily with him while your condo is ready.
He can also visit his mother and stay with her if she wishes him to visit and stay.
Then after MOP if your brother wishes to sell his HDB to you, you can purchase from him at an agreed price. Willing buyer, willing seller. I assume you would have sold your condo by then so you can use the proceeds to buy his HDB flat.
