Hi Gurus,
My daughter and her husband intend buy a resale HDB flat.
Both are SC. Can she register as single-Owner while her husband as occupant?
Reason is: she will be the one paying for the flat with cash + her CPF.
If they sell the flat after 5-yr, how the money will be returned?
In case they divorced, can my daughter take over the ownership of the flat?

Hi John,

Such arrangements can be made, however, when it come to matrimonial splits, it is not up for us to decide if such arrangements can be made unless they make a private nuptial agreement on this. Even with this, should the husband decide to challenge, the dispute may still take time to settle although it does put your daughter in a better position to fight for her cause.

Hi,

Yes its possible to buy as 1 owner 1 essential occupier arrangement. If its a normal sale, the sale proceeds and cpf refund will go to the owner solely since only 1 owner. In the event of divorce, its more challenging to predict if its contested since the courts will look at the situation and deem the best way to deal with the matrimonial property.

Sole Ownership: Your daughter can be the sole owner of the flat, while her husband is listed as an occupier. This means she will have full control over the property.

Financing the Purchase: Since your daughter is paying for the flat using her cash and CPF, she will be the one whose funds are used for the purchase.

Selling the Flat After 5 Years: If they decide to sell the flat after the Minimum Occupation Period (MOP) of 5 years, the proceeds from the sale will be returned to the owner (your daughter). This includes the amount used from her CPF, which will be refunded back to her CPF account.

In Case of Divorce: If they get divorced, the ownership of the flat can be transferred. Since your daughter is the sole owner, she will retain ownership unless otherwise determined by a court order or mutual agreement during the divorce proceedings.

This arrangement ensures that your daughter retains control and ownership of the flat, aligning with her financial contribution to the purchase.

Hi John,

1) Yes, a married couple can have only 1 to be listed as the sole owner. The spouse shall be the core (essential) occupier.
2) The core occupier has to agree to the sale of the HDB flat upon MOP.
3) The core occupier has to perform document endorsement to allow the sale before the HDB can approve after checking the document.
4) In a sale of property, the sale proceeds shall be distributed according to priority:
(a) Outstanding loan
(b) Utilized funds from CPF and accrued interest
(c) cash if any, shall be in the form of a cashier order bearing only the owner's name.

5) In the case they divorced, your daughter must meet the HDB eligibility scheme in order to retain the flat.
6) Your daughter shall always be the only owner of the flat. No changes in the ownership no matter what happened to their marriage.
